Adult-Use Marijuana Licenses: Early Applications Opened January 19th

Passing with 60% of the vote, Proposition 207, the Smart and Safe Act, legalizes the possession, cultivation, and sale of recreational marijuana in Arizona. A separate license issued by the Arizona Department of Health Services (“AZDHS”) will be required for retail sales of marijuana.

The early application period for existing medical marijuana dispensaries opened January 19th. Here’s what dispensaries interested in applying for a license to sell recreational marijuana should know:

  1. Application Period:  The early application period begins January 19th, and will end on March 9, 2021.

The Equal Employment Opportunity Commission (“EEOC”) issued a highly anticipated update to its publication, “What You Should Know About COVID-19 the ADA, the Rehabilitation Act, and Other EEO Laws.”  The new guidance addresses whether employers can require employees be vaccinated before returning to work and how such COVID-19 vaccinations interact with the legal requirements of the Americans with Disabilities Act (“ADA”), Title VII of the Civil Rights Act of 1964, the Pregnancy Discrimination Act, and the Genetic Information Nondiscrimination Act (“GINA”).

Payroll Protection Program Updates – Changes to Expense Deductions, New Funding, Expansion of ERC Credit, COVID Leaves and More

On Sunday, December 27th, President Trump signed into law the Consolidated Appropriations Act of 2021 (the “Act”) which enacts many important changes to the Payroll Protection Program (“PPP”).  Key changes brought about by the Act include:

  1. Families First Coronavirus Response Act Leave Mandate Expires December 31, 2020, but Tax Credits Continue: The Emergency Paid Sick Leave and Emergency Family and Medical Leave Expansion mandate expires December 31, 2020.  After December 31, 2020, employers with fewer than 500 employees will no longer be required to provide paid leave to employees for COVID-19 related reasons.
