Kevin Blakley and Greg Gnepper Prevail in Bankruptcy Dispute
Attorneys Kevin Blakley and Greg Gnepper recently prevailed in a disputed bankruptcy matter. Confirmation of a proposed Chapter 11 Plan of Reorganization was contested. Our client was a financial institution with a large claim secured by real property. If confirmed, the Plan would have forced our client to reduce its claim by the value of collateral—even though the client preferred not to foreclose. After an evidentiary hearing and full briefing, the court rejected the Plan as not being “fair and equitable.”

Kevin Blakley and Greg Gnepper Win Major Commercial Loan Litigation Case
Attorneys Kevin Blakley and Greg Gnepper recently prevailed in hotly contested litigation over a commercial loan. At stake was a post-foreclosure deficiency claim exceeding $5 million. The parties disputed the value of commercial property that served as collateral, and certain defendants also argued that language in the loan documents limited their exposure. After a full trial involving multiple expert witnesses, our client prevailed on all issues—and the Arizona Court of Appeals affirmed the judgment in all respects. Susan Demmitt to Participate in ULI Technical Assistance Panel to Look at Eloy Downtown
Susan Demmitt will be part of a group of real estate and development experts that will discuss the City of Eloy’s Downtown Area on April 30th. Termed a Technical Assistance Panel or TAP, the group of panelists has been organized by the Arizona District Council of the Urban Land Institute (ULI) to discuss possible strategies and tactics that can improve Main Street in the future.
