Our depth of experience allows us to effectively and efficiently handle any collection matter.

Collections and bankruptcy, also referred to as creditor’s rights, is a foundational practice group at Gammage & Burnham.

We regularly represent financial institutions and lenders, healthcare providers, contractors and subcontractors, architects, agrichemical and materials suppliers, property owners, municipalities, and other judgment holders. We also work with debtors in bankruptcy filings, pre-bankruptcy planning and strategy, and defending creditor claims.

Within this practice group, our experienced team has a background in the following areas:

Agriculture
Our attorneys have experience ensuring payment for crops, livestock, seed, fertilizers and pesticides. Methods of collection include a variety of tactics, including lien enforcement and repossession.

Bankruptcy
From Chapter 7 liquidations to Chapter 13 individual reorganizations and Chapter 11 business reorganizations, Gammage & Burnham has a wide range of experience in bankruptcy filings. Our attorneys assist with schedules and statements, objecting to discharge, challenging exemptions and seeking dismissals, among other bankruptcy-related tasks.

Construction Claims
Our attorneys have expertise in construction-related claims, including bond claims, liens and stop-payment notices.

Distressed Real Estate
Distressed assets have the ability to spawn unusual legal issues, and our team is well-versed in finding innovative solutions. Local and national clients benefit from our expertise when it comes to the repositioning of distressed assets, developer-negotiated work-outs and lender resolutions, and investor-backed short sale or trustee sales.

Lease Enforcement
Our attorneys are adept at devising solutions for commercial and residential landlords who may need assistance with lease modification, eviction actions, complex lease litigation or simple collections.

Secured Creditors
Creditors who bargain for security may need legal support for enforcement. Our attorneys are experienced in enforcing secured debts by way of foreclosures and trustee sales, receiverships for income-producing or at-risk assets, replevins, and foreclosures and forced sales under mechanic’s and other statutory liens.

Unsecured Creditor Claims
Our team assists clients in judgment enforcement, which may mean locating assets and securing their seizure, pursuing fraudulent transfers, suing other responsible parties or coordinating pre-judgement remedies.
