Probate and Fiduciary Law
We routinely represent personal representatives and trustees, advising them of their fiduciary duties and responsibilities during the post-death phases of administering probate estates and trusts. We provide assistance from the initial filing of any necessary court pleadings through to the final distribution of assets to the appropriate beneficiaries. In addition to these routine matters, we are often consulted to assist in resolving a wide array of issues that may arise during the post-death administration from assisting the trustee or personal representative (fiduciary), to interpreting confusing or ambiguous language in a will or trust, to advising the fiduciary regarding his or her duties and responsibilities to the beneficiaries and others, and representing the fiduciary when dealing with litigious beneficiaries. We also represent beneficiaries when necessary to protect their interests in situations where a fiduciary has failed to properly administer an estate or trust.
