Zoning and Land Use Planning
Our zoning and land use group represents property owners and developers seeking necessary entitlements for the development of their projects. Projects we have represented include master planned communities, employment campuses for single and multiple employers, regional shopping centers and power centers, office parks, apartment complexes, and schools and churches. The firm has represented projects well in excess of 5,000 acres and smaller than a single acre. The firm has also represented homeowners, neighborhood associations and other community groups who are concerned about projects proposed for their neighborhoods. On occasion, the firm has represented municipalities in land use issues. The firm has been involved in numerous cases involving the right to referendum. The firm has been on the successful side of several seminal Arizona decisions on referendum issues. Referendum litigation not only requires mastery of a highly specific area of the law, but also typically involves being able to litigate a case in a matter of days or weeks, as election litigation is often accelerated in Arizona. The firm specializes in projects involving lands owned by the Arizona State Land Department. The Land Department is the largest owner of property in the State, and as the metropolitan area has grown, the Land Department has become more and more important in providing opportunities for master planning efforts. Practice in the area requires extreme sophistication and familiarity with issues related to the Arizona Constitution and the federal Enabling Act.
