Profile
James Polese was the founding member of Polese Hiner & Nolan PA and Polese Pietzsch Williams & Nolan PA. Mr. Polese joined Gammage & Burnham in February 2008. Since his admission to the Arizona Bar, Mr. Polese has had extensive experience in both an office practice involving tax and business planning for small and medium size businesses as well as a commercial litigation.

Mr. Polese’s history of representing IMPRA, Inc., a medical products company now acquired by C.R. Bard and renamed as Bard Peripheral Vascular, has resulted in his involvement in two very significant patent infringement cases against W.L. Gore & Associates over Teflon® technology. The first was in the 1980s where he spearheaded the defense of a patent infringement case brought by Gore, in which one of Gore’s seminal patents was declared invalid. In 2008, he was involved in the $185 million patent infringement jury award entered against Gore on a patent owned by Bard PV. Mr. Polese has been involved in a number of published appellate decisions from the Federal Circuit, Ninth Circuit and the Arizona Court of Appeals.

Mr. Polese has also been a writer and speaker on business, tax and estate planning matters, He continues to serve on the Advisory Board of the Phoenix Tax Workshop.

Mr. Polese prefers to spend his off time on his 170-acre farm in Southwest France with his wife of 40 years, Rita. He has 2 grown children, a married daughter and a son who is a naval aviator. Mr. Polese is also a retired officer from the U.S. Army.
